The former head of the Department of Justice spoke to the then Garda Commissioner for almost 15 minutes during a recess at the O’Higgins Commission, the Disclosures Tribunal has heard.
Noel Waters does not recall the phone conversation he had with Noirin O’Sullivan, but admits the phone number in Ms O’Sullivan’s records was his office landline.
The Disclosures Tribunal is examining whether Commissioner O’Sullivan relied on false allegations of abuse to discredit Garda Whistleblower Maurice McCabe at the O’Higgins Commission.
At the time of the phone call, the Commission was on a break as legal counsel for Noirin O’Sullivan checked his instruction from the Commissioner to attack the motivation of Sergeant McCabe.
Mr Waters, who retired in November, has said he does not recall receiving an email outlining the legal strategy to discredit McCabe in May 2015.
