The loophole lets drivers avoid reaching 12 penalty points, which would normally result in a six-month driving ban.
A woman who was supposed to get five penalty points for not wearing a seat belt had them removed and was instead banned from driving for just 24 hours.
This happened because of a legal loophole highlighted by the Irish Times more than a year ago.
Judge Desmond Zaidan at Naas District Court agreed to the swap last month.
It was the second time the woman used this rule to avoid penalty points.
In December, she got a similar one-day ban and a €500 fine for using her phone while driving.
The loophole lets drivers avoid reaching 12 penalty points, which would normally result in a six-month driving ban.
Even though a new law was passed to fix this, it hasn’t been put into action yet.
If some drivers are succesful in obtaining an ancillary disqualification order for a short period, the points will not be endorsed and they can resume driving.
