The assault occurred on 16 September on Cork Street, Dublin 8
A man accused of attacking TD Michael Healy Rae in Dublin has been granted High Court Bail.
51-year-old Anthony Foley of Rosary Road in Maryland in Dublin 8 is charged with assault causing harm to the politician on September 16th of this year.
Mr. Foley was denied bail when he appeared before a court two days after the alleged incident on Cork Street in the Dublin 8 area.
However he appealed that decision before the High Court.
The judge addressed Garda objections the accused would fail to appear in court and concerns over potential witness interference through social media or through the TD's workplace - she said there was no evidential basis for those fears.
She noted the seriousness of the alleged incident in broad daylight, and was satisfied a conviction in this case would likely result in a custodial sentence.
The judge also addressed a Garda concern that granting bail may lead to another serious offence targeting a politician.
She said she was "not convinced it was clearly politically motivated."
Bail was granted subject to strict conditions including signing on twice daily at his local garda station, a night time curfew and a complete exclusion from the Dublin 2 area, among other conditions.
The Judge required an independent surety of €500 to be approved.
Meanwhile the accused must also lodge his own bond of €1,400.
Deputy Healy Rae was not required to attend today's appearance.
