A Kildare-registered developer and two Dublin-based site owners have been ordered to demolish dozens of unauthorised homes at Chianti Park in Brittas.
The Circuit Civil Court ruled that 29 modular houses built by Branach Developments, registered in Caragh, were entirely new structures and not refurbishments, as claimed.
Judge John O’Connor, according to the Irish Times, found the development amounted to a serious redevelopment without planning permission.
The enforcement case was taken by South Dublin County Council and a local resident, after works continued despite court proceedings.
The site is owned by Mullnassa Limited and Threshford Limited.
All parties are appealing the ruling, with a short stay granted until this evening to allow weatherproofing of materials on site.
