Shane O’Farrell was killed in a hit-and-run incident in August 2011 by a person who was on bail for a series of offences.
The O’Farrell family welcome the publication of the Report into the efficiency of the bail laws in
The report compiled by Lorcan Staines Senior Counsel was commissioned by Minister for Justice Jim O' Callagahan.
The Report’s finding that the current system is “cumbersome, inefficient, inconsistent and haphazard” with poor information sharing between the Courts Service, An Garda Síochána, and other State agencies, resulting in weak oversight of bail compliance.
The O'Farrell family welcome the Report’s recommendations particularly:
(1) that the Bail Act be amended allowing a member of the Gardai to arrest someone without warrant who they reasonably suspect has breached a term of their bail conditions.
(2) that the responsibility for the prosecution of offences be removed from the Gardaí and that all future court proceedings be conducted by legal professionals.
(3) the immediate investment in information-sharing systems for the Courts Service, Gardai and other police forces.

They are calling on the Government to act swiftly on these recommendations to ensure bail laws are enforced and public safety is protected.
